Mr. and Mrs. Liang gained Work visa, their son got Student Visa
Due to the global economic recession, the unemployment rate in New Zealand rose. As a result the Minister of Immigration announced stricter criteria for the issuing of work visas in order to protect the local labour market. Mr and Mrs Liang approached Phoenix International to request assistance with the lodgment of their work visa application s and their son’s student visa.
We assisted Mr. Liang prepare his application and worked with the employer to bring together all the necessary supporting documentation. Immigration New Zealand work closely with Work and Income New Zealand (WINZ) to determine whether there are any suitably qualified New Zealand citizens or residents available to do a job where a work visa has been requested for that position. On this occasion, and with stricter criteria in place, WINZ advised INZ that they believed they could fill this vacancy using local labour. INZ therefore declined Mr Liang’s work visa.
We did not agree with this outcome and subsequently sought an urgent review of the decision to decline the work visa application. INZ agreed to review the decision to decline the work visa application, and in doing so, overturned their original decision to decline the work visa application. Mr and Mrs Liang had their work visas approved and their son had his student visa approved.
With perseverance and a solid understanding of the immigration process we were successfully able to challenge a decision to decline work visas and subsequently have the work visas approved. Not all situations are straight forward so it is important your immigration advisor is experienced has a solid understanding of all immigration processed whilst maintaining a good working relationship with INZ.
